In this article the author revisits Carol Smart’s 1989 publication Feminism and the power of law. She engages with Smart’s main claims by way of a number of other thinkers. Following Marianne Constable’s description of contemporary American legal thought as socio-legal, the author tentatively considers if it could be argued that some strains in contemporary legal feminism that adopted a sociological method resulted in a similar absence of justice that concerns Constable. Smart’s caution against the development of a feminist jurisprudence (...) is critically analysed with the benefit of hindsight. Drawing on Deleuze and Guattari, Foucault and Goodrich, the author tentatively considers the becoming of a feminist jurisprudence as a minor jurisprudence.What we most lack is a belief in the world, we’ve quite lost the world, it’s been taken from us. Philosophy typically ignores biographical, historical, and cultural aspects of theorists' lives in an attempt to take a supposedly abstract and objective view of their work. This book makes some new conclusions about Arendt’s theory by emphasizing how her experience of the world as displayed in her archival materials impacted her thought. Some aspects of Arendt’s life have been examined in detail before, including the fact she was stateless as well as her affair with Heidegger. Instead, this work explores different topics (...) including the biographical and narrative moments of Arendt's own work, the role of archiving in her thought, pivotal events that have not been archived, her understanding of her own identities, and how it affected the role of identity politics in her work. Typically, group action is underemphasized in Arendt scholarship in comparison to individual action and often identity politics questions are considered to lie within the realm of the private. Although Arendt’s theory is problematic when discussing issues concerning identity politics, she did think identity politics could be public and political and that effective political actions may occur within groups. What makes this project unique are the innovative conclusions made by moving the archival and biographical evidence to the center in order to understand her theory more accurately and within its historical and cultural context. Over the years, many scholars have focused on the hierarchical and overpowering influence of Martin Heidegger upon Hannah Arendt’s thought. This view follows the stereotype concerning philosophical influence in which an all-knowing teacher affects the thought of the student, particularly if the student is a woman. In this paper, I argue that the story of philosophical influence is more complicated. In this case, the biographical archive establishes how Karl Jaspers, Martin Heidegger, and Hannah Arendt mutually influenced one another throughout their (...) lives and careers. This evidence contests the typical view of philosophical influence which is hierarchical and often gendered and suggests a new model for understanding philosophical influences as dynamic and reciprocal. Canada’s Truth and Reconciliation Commission (TRC) is tasked with facing the hundred-year history of Indian Residential Schools. The South African Truth and Reconciliation Commission is frequently invoked in relation to the Canadian TRC, perhaps because this is one of the few TRCs worldwide that Canadians know. Whilst the South African TRC is mainly applauded as an international success, I argue that loose analogizing is often more emotive than concise. Whilst much indeed can be drawn from the South African experience, it (...) is important to specify the Canada–South Africa analogy. In this article, I do so by focussing on the institutional approach to truth and how this relates to issues of settler/White denial. The South African experience teaches that narrow approaches to truth collude with superficial views of reconciliation that deny continuities of violence. Consequently, I argue that Indigenous–settler reconciliation requires a broad truth that locates residential schools on a continuum of violence, linking extraordinary abuses with structural injustices and historic colonization with lived relationships. Nietzsche claimed to be a philosopher of the future, but he was appropriated as a philosopher of Nazism. His work inspired a long study by Martin Heidegger and essays by a host of lesser disciples attached to the Third Reich. In 1935, however, Karl Jaspers set out to "marshall against the National Socialists the world of thought of the man they had proclaimed as their own philosopher." The year after publishing Nietzsche , Jaspers was discharged from his professorship at Heidelberg (...) University by order of the Nazi leadership. Jaspers does not fall into the same trap as idealogues do, citing bits and pieces from Nietzsche's work to reinforce already held opinions. Instead, he openly shows the wide range of Nietzsche's views, including his endorsement of wars and warriors, his prophecies of world struggle and "new masters," and the cruel arrogance of the supermen. Yet Jaspers finds Nietzsche's philosophy to be extraordinary not only because he foresaw all the monstrosities of the twentieth century, but also because he saw through them. "The appearance which Nietzsche's work presents can be expressed figuratively: it is as though a mountain wall had been dynamited the rock, already more or less shaped, conveys the idea of a whole. This radical, profoundly scholarly book explores the purposes and nature of proof in a range of historical settings. It overturns the view that the first mathematical proofs were in Greek geometry and rested on the logical insights of Aristotle by showing how much of that view is an artefact of nineteenth-century historical scholarship. It documents the existence of proofs in ancient mathematical writings about numbers and shows that practitioners of mathematics in Mesopotamian, Chinese and Indian cultures knew how to prove (...) the correctness of algorithms, which are much more prominent outside the limited range of surviving classical Greek texts that historians have taken as the paradigm of ancient mathematics. The ArgumentTo highlight speculative trends specific to the mathematical tradition that developed in China, the paper analyzes an excerpt of a third-century commentary on a mathematical classic, which arguably contains a proof. The paper shows that the following three tasks cannot be dissociated one from the other: (1) to discuss how the ancient text should be read; (2) to describe the practice of mathematical proof to which this text bears witness; (3) to bring to light connections between philosophy and mathematics (...) that it demonstrates were established in China. To this end the paper defines its use of the word “proof” and outlines a program for an international history of mathematical proof. It describes the sense in which the text conveys a proof and shows how it simultaneously fulfills algorithmic ends, bringing to light a formal pattern that appears to be fundamental both for mathematics and for other domains of reality. The interest in transformations that mathematical writings demonstrate in China at that time seems to have been influenced by philosophical developments based onThe Book of Changes (Yi-jing), which the excerpt quotes. This quotation within a mathematical context makes it possible to suggest an interpretation for a rather difficult philosophical statement. (shrink)

Isaac Newton, in popular imagination the Ur-scientist, was an outstanding humanist scholar. His researches on, among others, ancient philosophy, are thorough and appear to be connected to and fit within his larger philosophical and theological agenda. It is therefore relevant to take a closer look at Newton’s intellectual choices, at how and why precisely he would occupy himself with specific text-sources, and how this interest fits into the larger picture of his scientific and intellectual endeavours. In what follows, we shall (...) follow Newton into his study and look over his shoulder while reading compendia and original source-texts in his personal library at Cambridge, meticulously investigating and comparing fragments and commentaries, and carefully keeping track in private notes of how they support his own developing ideas. Indeed, Newton was convinced that precursors to his own insights and discoveries were present already in Antiquity, even before the Greeks, in ancient Egypt, and he puts a lot of time and effort into making the point, especially, and not incidentially, in the period between the first and the second edition of the Principia. A clear understanding of his reading of the classic sources therefore matters to our understanding of its content and gestation process. In what follows we will confine ourselves to the classical legacy, and investigate Newton’s intellectual intercourse with it. (shrink)

The Japanese scholar Miura Baien (1723-1789) worked throughout his life to produce a philosophical analysis of the natural world. Misinterpretations of his intentions arise from drawing diagrams on his behalf that are inconsistent with his text, or by applying to his text Western academic terms that are quite foreign to his thought. When Baien's text is examined in his own terms we can understand its significant role in the scientific thought of the Edo period.

The use of black box algorithms in medicine has raised scholarly concerns due to their opaqueness and lack of trustworthiness. Concerns about potential bias, accountability and responsibility, patient autonomy and compromised trust transpire with black box algorithms. These worries connect epistemic concerns with normative issues. In this paper, we outline that black box algorithms are less problematic for epistemic reasons than many scholars seem to believe. By outlining that more transparency in algorithms is not always necessary, and by explaining that (...) computational processes are indeed methodologically opaque to humans, we argue that the reliability of algorithms provides reasons for trusting the outcomes of medical artificial intelligence. To this end, we explain how computational reliabilism, which does not require transparency and supports the reliability of algorithms, justifies the belief that results of medical AI are to be trusted. We also argue that several ethical concerns remain with black box algorithms, even when the results are trustworthy. Having justified knowledge from reliable indicators is, therefore, necessary but not sufficient for normatively justifying physicians to act. This means that deliberation about the results of reliable algorithms is required to find out what is a desirable action. Thus understood, we argue that such challenges should not dismiss the use of black box algorithms altogether but should inform the way in which these algorithms are designed and implemented. When physicians are trained to acquire the necessary skills and expertise, and collaborate with medical informatics and data scientists, black box algorithms can contribute to improving medical care. It will be shown in this article that an ontological approach for some problems related to the interpretation of Quantum Mechanics (QM) could emerge from a re-evaluation of the main paradox of early Greek thought: the paradox of Being and non-Being, and the solutions presented to it by Plato and Aristotle. More well known are the derivative paradoxes of Zeno: the paradox of motion and the paradox of the One and the Many. They stem from what was perceived by classical (...) philosophy to be the fundamental enigma for thinking about the world: the seemingly contradictory results that followed from the co-incidence of being and non-being in the world of change and motion as we experience it, and the experience of absolute existence here and now. The most clear expression of both stances can be found, again following classical thought, in the thinking of Heraclitus of Ephesus and Parmenides of Elea. The problem put forward by these paradoxes reduces for both Plato and Aristotle to the possibility of the existence of stable objects as a necessary condition for knowledge. Hence the primarily ontological nature of the solutions they proposed: Plato’s Theory of Forms and Aristotle’s metaphysics and logic. Plato’s and Aristotle’s systems are argued here to do on the ontological level essentially the same: to introduce stability in the world by introducing the notion of a separable, stable object, for which a ‘principle of contradiction’ is valid: an object cannot be and not-be at the same place at the same time. So it becomes possible to forbid contradiction on an epistemological level, and thus to guarantee the certainty of knowledge that seemed to be threatened before. After leaving Aristotelian metaphysics, early modern science had to cope with these problems: it did so by introducing “space” as the seat of stability, and “time” as the theater of motion. But the ontological structure present in this solution remained the same. Therefore the fundamental notion ‘separable system’, related to the notions observation and measurement, themselves related to the modern concepts of space and time, appears to be intrinsically problematic, because it is inextricably connected to classical logic on the ontological level. We see therefore the problems dealt with by quantum logic not as merely formal, and the problem of ‘non-locality’ as related to it, indicating the need to re-think the notions system, entity, as well as the implications of the operation ‘measurement’, which is seen here as an application of classical logic (including its ontological consequences) on the material world. "Thinking about thinking", the topic of this section of our volume, leads us into an Escherian web of self-referential interconnections — which nevertheless make sense, at least if we do not shy away at once in the face of paradox, for fear of inconsistency. How do our critical faculties enter the picture? Adding a few conceptual dimensions to the merely linearly causal one may help us to shed light on the issue, and may help us also to understand some of (...) the basic strategies "Western" thought has developed throughout its historical pathway in its conscious dealings with the 'real'. Of course, in a few pages it is impossible to do justice to this complicated subject. But I'll try to give the reader an as clear as possible description of the, in my view, crucial issues, pointing out the ways they resonate into the many fields of interest represented in the intended readership, and leave it to the reader to dig deeper through the given references. In feminist media studies, the growing body of research on media production has indicated that journalism remains divided along gender lines. The purpose of this study is to address the lack of relevant multi-method research on gender inequality in journalism. To assess the structural position of women in the journalistic workforce, the authors conducted a large-scale survey of journalists in Belgium. The survey results were explored in more depth by conducting qualitative interviews with 19 female journalists. The analysis confirms the (...) existence of all traditional barriers that women journalists experience. The added value of this study is that it enumerates several additional difficulties, and offers insight into the strategies that the respondents use to deal with gender-related career obstacles. These strategies were associated with the degree of flexibility in the newsroom for journalists with children, the choice to work part-time or freelance, and the use of new communication technologies. Many ethical concerns have been voiced about Clinical Decision Support Systems (CDSSs). Special attention has been paid to the effect of CDSSs on autonomy, responsibility, fairness and transparency. This journal has featured a discussion between Rosalind McDougall and Ezio Di Nucci that focused on the impact of IBM’s Watson for Oncology (Watson) on autonomy. The present article elaborates on this discussion in three ways. First, using Jonathan Pugh’s account of rational autonomy we show that how Watson presents its results might (...) impact decisional autonomy, while how Watson produces knowledge might affect practical autonomy. Second, by drawing an analogy with patient decision aids we identify an empirical way of estimating Watson’s impact on autonomy (ie, value-congruence). Lastly, McDougall introduced the notion of value-flexible design as a way to account for the diverging preferences patients hold. We will clarify its relation with the established domain of value-sensitive design. In terms of the tripartite methodology of value-sensitive design, we offer aconceptualclarification using Pugh’s account of rational autonomy, anempiricaltool to evaluate Watson’s impact on autonomy and situate a group oftechnicaloptions to incorporate autonomy in Watson’s design. In times of person-centered care, it is all the more important to support patients in making good decisions about their care. One way to offer such support to patients is by way of Patient Decision Aids (PDAs). Ranging from patient brochures to web-based tools, PDAs explicitly state the decisions patients face, inform them about their medical options, help them to clarify and discuss their values, and ultimately make a decision. However, lingering discussions surround effectiveness research on PDAs. In this article, (...) I focus on two subjective measures of decision quality that are widely used as outcome measures in effectiveness research on PDAs (i.e., the Decisional Conflict Scale (DCS) and measures of regret). Although these measurement instruments have attracted critical attention in the scientific literature, bioethicists have hardly engaged with them. Therefore, I set myself to analyze the relationship between (the different subscales of) the DCS and measures of regret, on the one hand, and ethical principles such as beneficence and autonomy, on the other hand. In light of that analysis, I will clarify some discussions regarding the use of these measures of decision quality in effectiveness research on PDAs. This should help us to align the way we evaluate PDAs with ethical principles and avoid that our attempts to support patients in making good decisions about their care that is so central to person-centered care point in unethical directions. The purpose of this study was to determine the development of moral judgement in first-year and senior baccalaureate nursing students. These students were enrolled in three separate nursing programmes, each of which differed significantly in ethical content. The sample totalled 180 students enrolled in three New England programmes. Programme A included an ethics course taught by a professor of ethics. Programme B integrated ethical issues into all nursing theory courses. Programme C did not include ethical content in theory courses. The (...) design was of a developmental cross-sectional study. The dependent variable was the development of moral judgement, as measured by Rest’s Defining Issues Test. The independent variable was the amount of ethics taught in the nursing programmes and the level of academic education. The senior nursing students from programme A scored significantly higher than the other senior groups on the Defining Issues Test. The conclusion is that an ethics course with group participation and a decision-making element significantly facilitated nursing students’ development of moral judgement. (shrink)

Demographic differences among consumer groups have become increasingly important to the development of marketing strategies. Marketers depend heavily on the sales force to implement strategies at the consumer level and, not surprisingly, different groups may view the salesperson’s role differently. Unfortunately, unethical sales practices targeted at various consumer groups, and especially at seniors, have been utilized as well. The purpose of this study is to provide initial empirical evidence of the ethical ideological make-up of four age segments outlined by Strauss (...) and Howe (1991, Generations: The History of America’s Future 1584–2069, Morrow, New York) and to examine the propensity for these groups (seniors, in particular) to respond differentially to potentially unethical sales tactics. Data were collected from 179 respondents representing the four generational age groups. MANOVA revealed that the seniors in this study were distinct with respect to ethical ideology and less accepting of unethical sales tactics. Managerial implications are discussed for sales organizations to maximize their effectiveness across consumer groups. (shrink)

The relationship between international order and justice has long been central to the study and practice of international relations. For most of the twentieth century, states and international society gave priority to a view of order that focused on the minimum conditions for coexistence in a pluralist, conflictual world. Justice was seen either as secondary or sometimes even as a challenge to order. Recent developments have forced a reassessment of this position. This book sets current concerns within a broad historical (...) and theoretical context; explores the depth and scope of this presumed solidarism amidst the difficulties of acting on the basis of a more strongly articulated liberal position; and underscores the complexity and abiding tensions inherent in the relationship between order and justice. Chapters examine a wide range of state and transnational perspectives on order and justice, including those from China, India, Russia, the United States, and the Islamic world.
